Terms & Conditions

1. Definitions

  • “Client”: The person or business requesting services from Gesiggie.
  • “Gesiggie”: A digital marketing and creative agency.
  • “Agreement”: Acceptance of a quote, invoice, or written service instruction, constituting acceptance of these Terms & Conditions.

2. Validity of Quote

  • All quotes are valid for 7 calendar days from the date of issue.
  • Prices are subject to change after the validity period.
  • Acceptance confirms agreement to these Terms & Conditions.

3. Payment Terms

  • A 50% deposit is required to confirm a booking and start work.
  • The remaining 50% balance is payable on project completion or as otherwise agreed.
  • Invoices are due within 7 days of issue unless stated otherwise.
  • Overdue payments will attract interest at 2% per month from the due date.

4. Project Commencement

  • Work begins only after:
    • Written approval or acceptance of the quote, and
    • Proof of deposit payment has been received.

5. Cancellations & Refunds

  • Deposits are non-refundable.
  • If a project is cancelled by the client after commencement, Gesiggie reserves the right to invoice for work completed up to that point.
  • Projects inactive or unresponsive for more than 30 days may be archived.

6. Revisions

  • All packages include up to 3 (three) rounds of revisions.
  • Additional revisions beyond this will be charged at an hourly rate or quoted separately.
  • Revisions must be submitted within 3 business days of draft delivery.

7. Ownership & Copyright

  • Ownership of all creative work remains with Gesiggie until full payment is received.
  • Upon full payment:
    • The client receives usage rights for final deliverables.
    • Raw files (e.g., PSD, AI, or source code) remain the property of Gesiggie unless agreed otherwise.
  • Gesiggie may showcase completed work in its portfolio and online platforms for promotional purposes.

8. Client Responsibilities

  • The client is responsible for:
    • Providing content, approvals, and access timeously.
    • Reviewing and responding to drafts or communications within 3 business days to avoid delays.
  • Delays caused by the client may result in extended timelines or additional charges.

9. Service Limitations

  • Gesiggie is not responsible for:
    • Platform outages, plugin conflicts, or software errors beyond its control.
    • Delays caused by third-party vendors (e.g., printers, web hosts, etc.).
    • Losses from misuse of design materials after delivery.

10. Force Majeure

  • Gesiggie shall not be held liable for failure to perform services due to circumstances beyond its control, including load shedding, illness, equipment failure, internet interruptions, or natural disasters.

11. Jurisdiction & Dispute Resolution

  • These terms are governed by the laws of the Republic of South Africa.
  • Disputes will be handled in the jurisdiction of the Cape Town Magistrate’s Court or a competent court as agreed by both parties.

12. POPIA Compliance

Gesiggie is fully compliant with the Protection of Personal Information Act (POPIA), Act No. 4 of 2013.

  • Client information is collected only for the purpose of communication, billing, and project fulfilment.
  • All personal information provided by the client will be kept confidential and secure, and will not be shared with any third parties unless required by law or with the client’s explicit consent.
  • Clients have the right to:
    • Request access to their personal data,
    • Correct or delete inaccurate data,
    • Withdraw consent for the use of their data at any time by contacting us in writing.
  • Gesiggie takes reasonable steps to prevent loss, misuse, or unauthorised access to all data in line with POPIA requirements.

13. Legal Compliance

  • These Terms comply with:
    • The Consumer Protection Act (CPA),
    • The Electronic Communications and Transactions Act (ECTA), and
    • The Protection of Personal Information Act (POPIA).
  • Clients are entitled to clear, fair, and transparent dealings.
